Examining the Battle for Trans Legal Protections: A Compelling Documentary Shows the Personal Narrative

Transgender filmmaker Sam Feder's recent feature "Increased Examination" offers a powerful dual perspective – both an emotional portrait of a key transgender activist and a pointed examination of journalistic coverage surrounding trans issues.

Legal Struggle at the Highest Court

This documentary follows ACLU attorney Chase Strangio as he gears up for court proceedings in the significant Supreme Court case the Skirmetti case. These proceedings took place in December 2024, with the judiciary finally deciding in favor of Tennessee's position, effectively permitting bans on healthcare for transgender young people to stay in place across numerous US states.

We produced Heightened Scrutiny in only 16 months, stated Feder during a discussion. Meanwhile, my previous film Disclosure took me five years, so this was very accelerated. Our intention was to generate conversation so people would understand more about the case.

Personal Narrative Amid Legal Struggle

Although Feder presents a comprehensive analysis of how prominent media outlets have spread anti-trans rhetoric, the film's most valuable accomplishment may be its compelling portrayal of Strangio. Normally a measured lawyer in media appearances, Strangio displays his humanity throughout the film.

That was a major challenge, to open up aspects of my life to a camera lens that I had made efforts to keep confidential, stated Strangio. Feder explained he wanted younger people to know that we struggled, to see what was done in defense of these battles for our material survival.

Diverse Perspectives in the Struggle

To enhance Strangio's story, Feder features multiple transgender advocates, including prominent figures from journalism and the arts. This film also features perspectives from non-trans advocates who critique how mainstream organizations have contributed to harmful portrayals of trans individuals.

The experience of trans youth central to the legal case is represented through a extraordinary 12-year-old activist named Mila. Audiences first see her fighting for her community at a educational meeting, with later moments showing her demonstrating for trans rights outside the Supreme Court.

Intimate Scenes Beyond the Legal Battle

This film also contains touching moments where Feder moves beyond the ongoing legal struggle, such as footage of Strangio traveling in Italy and receiving a body art featuring lines from activist Pauli Murray's poem "Prediction."

This ink moment is among my favorites in the movie, explained Strangio. Getting inked is practically like a meditative experience for me, to be totally engaged in my body and to think of it as a container for things that are meaningful to me.

Physical Identity and Representation

Feder's dedication to carefully documenting Strangio adding to his body art underscores that this film is essentially about trans physical selves – not just those of youth who confront prohibition of their ability to live genuinely in their own bodies, but also the physical forms of the many subjects who are featured in the production.

I produce films with a message, and part of that is picking people who are exceptional and articulate enough to sustain the camera, stated Feder. Whenever people ask me what they should dress for an interview, my reply is whatever makes you feel attractive. That is important to me – as transgender individuals, we have difficulties so much with our self-perception.

Impact and Optimism

A key factor that causes Feder's films excel is his clear skill for making his transgender participants feel at ease, seen and valued. This methodology creates real chemistry between Feder and Strangio, enabling the filmmaker to achieve his aim of portraying Strangio as a multifaceted person and providing a record for posterity of how resiliently he and fellow activists have fought for trans rights.

I don't want people to find themselves in a situation of incessant discouragement because of what the law is failing to provide us, shared Strangio. I strive to be in a practice of using the law to minimize harm, but not to turn it into some type of conduit for our liberation potential. Official institutions is not going to be the reflection through which we perceive ourselves. We are that reflection, and it's very important that we persist having that dialogue in addition to dialogues about resisting these regulations and practices.
